Contract with a foreign orchestra, documents to be supplied for authorizations

Tuesday, 05 July 2005

“In connection with temporary work permits, and in addition to the customary documents, Direccte* requires me to supply a copy of all individual employment contracts entered into between the orchestra and the musicians in their country. Is this standard practice?”

Generally speaking, applications for temporary work permits are made by the employer.

However, if there is an intermediary in France (artistic agent, entertainment organizer, tour promoter, etc.), the latter may file the application with his local branch of the Direccte*.

If a French company is duly empowered by an employer based abroad to submit applications for work permits on the latter’s behalf, the documents normally required are:
  • the contract with the contracting party based in France (except for self-productions);
  • documents proving registration in the trade registers of the country of origin;
  • documents proving the social security and tax position in the country of origin;
  • the employment contract (stating the amount of wages in particular);
  • a sworn affidavit certifying that the salaried workers are legally employed in the country of origin.
The employment contract must in principle always be supplied to obtain work permits. If you are applying on behalf of an employer based abroad, the Direccte* is quite entitled to ask for the employment contracts between the artists and the said employer based abroad.
