Work permits for foreign workers, details on the new applicable procedures

The new legislative and regulatory provisions on work permits for foreign nationals1 are set out in a circular dated 22 August 2007, published in the Ministry of Employment’s official listing of 30 September 2007.
It itemizes all the categories of work permit, which include: temporary residence permit marked “artistic and cultural profession” or “temporary worker”, “skills and talents” residence permit, temporary work permit (APT).
Since their time of work is generally less than three months, most artists are covered by the temporary work permit (APT), the rules of which remain largely unchanged.Nb > See article Issuing performing artists and technicians with temporary work permits and the Entertainment fact sheet entitled Foreign artist - resident’s and work permit
However, all applications for work permits are henceforth filed by the employer, whether the foreigner is in his country of origin (a procedure known as “introduction”) or on French territory (a “change of status” procedure).
Nb > The application may also be filed by a person duly approved by the employer provided the said person has a specific power of attorney to that effect.
The new provisions concern changes of status, applications for which were filed by the foreigners themselves until now. This concerns foreigners already legally residing in France and already having a residence permit allowing them to stay in France but not to have a salaried occupation as their main activity.
