Temporary work permits or temporary residence cards for artistic and cultural professions

Generally, foreign nationals who wish to temporarily work for a salary in France are given a temporary work permit (autorisation provisoire de travail or A.P.T.).

The duration of the A.P.T. is limited to 9 months, renewable within the limits of the job mission for which it is requested.
For periods of over 3 months the A.P.T. is coupled with a « temporary worker » temporary residence card which is valid for the same duration as the A.P.T and includes a reference to it.
For artists, the residence card carries the reference « artistic and cultural profession ».

Nb > Foreign nationals who are already residents of France and who are authorized to work there can practice the profession of their choice and therefore do not need to request a specific work permit. This pertains to foreign nationals who hold the following documents :
long term residence card ;
> « salaried employment » temporary residence card without geographic or professional restrictions ;
> « artistic and cultural profession » temporary residence card ;
> « private and family life » temporary residence card ;
> for
Algerians, a 10-year residence certificate or a one-year residence certificate which carries the same references as the residence cards mentioned above.


Artists working in France for a period of less than 3 months

The artist is issued a temporary work permit.

There is no intervention by the ANAEM , and no fee is required.

No residence permit or card is required. However, a short-term visa is often necessary.

If the artists is still in his or her country of origin

The request for the A.P.T. is filed by the employer (or an agent mandated to that effect) with the Direccte where the employer’s principal business is based. The request is processed by the Direccte.

If the request is approved, a work contact validated by the Direccte is sent to the employer who then sends it to the artist so that the artist may obtain an entrance visa from the French consulate if required.

If the request is denied, the employer is notified of the refusal of the A.P.T.

If the artists is already on french territory

If the artist is already legally on French territory but does not have authorization to work, the A.P.T. request is filed by the artist (or by the artist’s agent mandated to that effect) at the prefecture of the artist’s place of residence.

The prefecture refers the request to the Direccte, where it is processed.
If the request is approved, the Direccte notifies the artist by mail and the artist is summoned to receive the A.P.T.
If the request is denied, both the artist and the employer are notified.
 
Artists working in France for a period of more than 3 months

For periods longer than 3 months, foreign artists must hold either a temporary work permit with a « temporary worker » temporary residence card or an « artistic and cultural profession » temporary residence card.

Requests for temporary residence cards are part of the entrance procedure when the artist lives in a foreign country or, more exceptionally, part of the change of status procedure when the foreign artist lives in France (students, holders of residence cards which do not authorize salaried employment).

In order to request a temporary residence card, foreign nationals must obtain a long-term visa before leaving their country of origin.

Artists residing in their country of origin : entrance procedure

Before the employee arrives in France, the employer must file the work contract with the Direccte where the employer’s principal business is based. The request is then processed by the Direccte. If the request is approved, the Direccte sends the file to the ANAEM. and simultaneously sends the validated contract to the employer. The employer sends the contract to the artist so that the artist may obtain an entrance visa from the French consulate.

The employer must then make an appointment with the regional delegation of the ANAEM. and pay the fee required for the medical examination (160 €).

The foreign artist will submit to the medical examination before receiving the residence card from the prefecture.

Artists legally residing in France without authorization to work : change of status procedure

When the artist residing in France holds a residence card which does not authorize the artist to work (student card, etc.), the artist must file a request for an « artistic and cultural profession » temporary residence card at the prefecture of his or her place of residence.
Requests which notably include a work contract for a period of more than 3 months are processed by the prefecture and the Direccte.
If the request is approved, the artist must submit to medical examination at the ANAEM after the employer has paid the required fee. Following this medical examination, a residence card with the reference « artistic and cultural profession » is issued to the artist by the prefecture.
